Group of 2 to 5 natural persons

Each person in the group must:

  • Be 18 years of age or older;
  • Be a resident of Québec (a Canadian citizen or a permanent resident domiciled in Québec) and ordinarily reside there;
  • Have complied, where applicable, with the financial obligations of a previous undertaking or, failing that, have reimbursed the amounts due;
  • Not be subject to a removal order under the Immigration and Refugee Protection Act;
  • Not be detained in a penitentiary or prison;
  • Not have been convicted, in Canada or abroad, of a murder or an offence set out in Schedule I or II of the Corrections and Conditional Release Act;
  • Have complied, over the last five years, with the obligations arising from a judgment ordering the payment of alimony or, failing that, have repaid all outstanding amounts;
  • Not be receiving last-resort financial assistance under the Individual and Family Assistance Act, except because of age or a disability that creates a severe and permanent or indefinite duration of hardship to employment;
  • Not be subject to a procedure to cancel his or her citizenship;
  • Prove, in accordance with the established financial scales, that he or she has sufficient income to fulfill their undertaking.

Note: The members of the group must commit themselves jointly and severally. Each member is responsible for the share of the other members who fail to fulfill their undertaking.

Legal person - Experienced or regular organization

There are two categories of legal persons—experienced organizations (E) and regular organizations (R)—which must meet specific conditions.

Every legal persons must:

  • Be incorporated under one of the following acts: Part III of the Companies Act, Religious Corporations Act, Roman Catholic Bishops Act, Act respecting fabriques or Professional Syndicates Act, or constitute a non-profit corporation under a law of Canada or of another province in Canada if it carries on business in Québec and is registered under the Act respecting the legal publicity of businesses
  • Have been in operation for at least two years
  • Not be a political party or party authority under Chapter I of Title III of the Election Act
  • Have complied, where applicable, with the financial obligations of a previous undertaking or, failing that, have reimbursed the amounts due
  • Show that it has sufficient funds to fulfill its undertaking, according to the established financial scales

In addition to meeting the above conditions, a Class E (experienced organization) non-profit organization must:

  • Have at least 10 years of sponsorship experience in Québec acquired over a period of 15 years
  • Have submitted, during the last application management period, the minimum number of undertaking applications allocated to it
  • Have made undertakings for immigration candidates of at least three different nationalities during the 36 months preceding the effective date of the Minister’s decision on the management of applications for the current year

Legal person ‒ Specific subclass (S)

A regular (R) or experienced non-profit organization (E) may qualify in the Specific subclass (S) if it exclusively submits undertaking applications as sponsor for immigration candidates who will settle outside the Communauté métropolitaine de Montréal (CMM) area.
